This site may contain other proprietary notices and copyright information, the terms of which must be observed and followed. Information on this site may contain technical inaccuracies or typographical errors. Information, including product pricing and availability, may be changed or updated without notice. ECUWEST and its subsidiaries reserve the right to refuse service, terminate accounts, and/or cancel orders in its discretion, including, without limitation, if ECUWEST believes that customer conduct violates applicable law or is harmful to the interests of ECUWEST and its subsidiaries.

Consumer Agreement

ECUWEST will not be held liable for any damage done to your vehicle that may occur while running these programs. Tuning files are a high performance product, whilst all care and due diligence has been taken the consumer is to take responsibility for modifying their vehicles. Modifying a car may void your warranty. ECUWEST will not be liable for any loss of warranty or the monetary damages that may occur from the loss of such warranties. The tunes and maps which ECUWEST install are designed to run on perfectly running vehicles with the allowed modifications. When other parts of the vehicle are not running properly, damages may occur and it is the responsibility of the vehicle owner to be sure all functions of the vehicle are running properly. The sale of each of these maps is intended to be installed on 1 vehicle. The maps are not to be shared, resold, or distributed in any way. Theses maps are not to be transferred to other vehicles after their use on another vehicle has ended. The use or distribution of any map on multiple vehicles without payment to ECUWEST will be a violation of copyrighted software. All tuning carried out by ECUWEST on any vehicle shall only be used off road or on closed circuits and racing venues. There are no refunds.

Dealer Agreement

ECUWEST will not be held liable for any damage done to dealers vehicles that may occur while tuning them. Tuning files are a high performance product, whilst all care and due diligence has been taken the dealer is to take responsibility for modifying their customers vehicles. Under no circumstances are dealers to refer their customers back to ECUWEST, dealers are to mediate with their customers themselves.
There are no refunds for dealer tuning tools. We may, at our discretion, refund tuning credits if choose to do so, but they will be kept in your account as tuning funds and not refunded as cash.

Do not use this product until you have carefully read the following agreement.  This agreement sets forth the terms and conditions for the use of the performance product and/or service. ***

DISCLAIMER Performance Products and Service

Read carefully before installing any performance product and/or service. This is a high performance product and service. Use at your own risk. Products and Service are for off road use only. Use of any ECUWEST product and/or service on public roads and/or used on any emissions controlled vehicles is prohibited.

DISCLAIMER Performance Warranty

By installing this Product and/or Service, the customer understands and agrees that as a High Performance product and/or service, individual results may vary depending on make, model, and usage. ECUWEST shall in no way be held responsible nor liable for any of the results, claimed or otherwise, that may or may not come from the product or service. The customer also understands that the original vehicle manufacturer makes its own determinations regarding the effects of Add-On products and/or service to its warranties, ECUWEST shall in no way be held responsible nor liable for anything pertaining to or resulting from the original vehicle manufacturers warranty and/or terms of use. This Product and/or service may interfere with and should be removed from the vehicle before any diagnostic testing.

DISCLAIMER OF LIABILITY

ECUWEST, its distributors or dealers shall in no way be responsible for the products proper use and service.  The buyer of this system hereby waives all liability claims.  The buyer acknowledges that he is not relying on the sellers skill or judgement to select or furnish goods and/or services suitable for any particular purpose and that there are no liabilities which extend beyond the description on the face hereof, and the buyer hereby waives all remedies or liabilities, expressed or implied arising by law or otherwise, (including without obligations of the seller with respect fitness, merchant-ability and consequential damages) or whether or not occasioned by the seller’s negligence. The seller disclaims any warranty and expressly disclaims any liability for personal injury or damages.  The buyer acknowledges and agrees that the disclaimer of any liability for personal injury is a material term for this agreement and the buyer agrees to indemnify the seller and to hold the seller harmless from any claim related to the item of the equipment or service purchased.  Under no circumstances will the seller be liable for any damages or expenses by reason of use or sales of any such equipment and/or service. The seller assumes no liability regarding the improper installation or misapplication of its products and/or services.  It is the installer’s responsibility to check for proper installation and if in doubt the manufacturer is to be contacted.

By installing any of the Products and/or Services, The customer Understands and Agrees that ECUWEST offers no warranty, refunds or returns on any high performance product and/or service, shipping & handling charges and/or processing fees.  Customers are responsible for insuring any items shipped to the company.
